The “honest services” statute, codified at 18 U.S.C. §1346, has been utilized by the government to prosecute a staggeringly wide swath of conduct in both the public and private sectors, ranging from private employees who the government charges has defrauded his employer by breaching some fiduciary duty owed to the company, to local, state and federal politicians charged with breaching their fiduciary duty to provide their constituents with their “honest services.” While the statute has been the subject of intense criticism as being unconstitutionally vague, and the United States Supreme Court is presently considering three separate cases charged under this statute, it remains a valued tool for the Department of Justice, which is presently defending the constitutionality of the statute before the Supreme Court.
