Honest Services Fraud
Areas of Practice

are currently involved in one of the highest profile “honest services” prosecutions in Massachusetts. If you or a family member is the subject of an honest services fraud investigation or prosecution, we invite you to contact us to learn more about the depth of our experience, skills and knowledge in this area.

The “honest services” statute, codified at 18 U.S.C. §1346, has been utilized by the government to prosecute a staggeringly wide swath of conduct in both the public and private sectors, ranging from private employees who the government charges has defrauded his employer by breaching some fiduciary duty owed to the company, to local, state and federal politicians charged with breaching their fiduciary duty to provide their constituents with their “honest services.” While the statute has been the subject of intense criticism as being unconstitutionally vague, and the United States Supreme Court is presently considering three separate cases charged under this statute, it remains a valued tool for the Department of Justice, which is presently defending the constitutionality of the statute before the Supreme Court. If you or a family member is the subject of such an “honest services” investigation or prosecution, it is critically important that you obtain legal representation as early as possible in the process, such that your attorney can immediately begin his investigation. We have the resources, experience and skills to effectively defend honest services fraud investigations or prosecutions, and invite you to contact us to learn more.

You were the best lawyer in the courtroom.

~ Federal Prosecutor, 2008, following complex, multi-defendant criminal trial

I was one of seven lawyers participating in an 8 week trial for multiple defendants in federal court in Cincinnati, Ohio. Rob Goldstein was one of the other lawyers. His preparation, mastery of the facts and performance in the courtroom were outstanding. I have been in practice for 33 years, with 4 years as an assistant county prosecutor and the rest as a criminal defense attorney. I have had more than 250 jury trials in my career and seen many lawyers try cases. Rob Goldstein is as fine an attorney as I have ever seen.

~ Co-Counsel, multi-defendant federal trial

I was astonished to learn he had graduated from law school only in 1995. I would have attributed another fifteen years experience to his resume.
