Food, Drug and Cosmetic Act Prosecutions
Areas of Practice

currently represent executives in a pending FDA-related investigation into alleged violations of the Food, Drug and Cosmetic Act and other relevant statutes, which can range from failing to follow cGMP’s (current Good Manufacturing Practices) and improper marketing practices to mislabeling and the sale of controlled substances. If you or a family member is the subject of such an investigation, we invite you to contact us to learn more about the depth of our experience, skills and knowledge in this area.

The government has increased the resources devoted to investigating and prosecuting these offenses, and the FDA is working in conjunction with the Department of Justice and other investigative agencies, including the DEA, to identify and prosecute what it believes to be violations of relevant Federal criminal statutes. Defenses to these prosecutions are often factually and legally complex, and it is therefore imperative that you obtain legal representation as early as possible, such that your attorney can immediately begin his investigation. The goal of any such investigation is often twofold: acquire information essential to persuading the government that you have not committed any federal offense and, if necessary, begin to prepare a defense to a federal prosecution in the event the government ultimately decides to seek an indictment. We have the resources, experience and skills to effectively defend FDCA investigations or prosecutions, and invite you to contact us to learn more.

Testimonials

I have spent a career watching and interacting with attorneys - as the elected district attorney, as a line prosecutor and defense attorney - you are one of a handful of the best lawyers I have ever seen in the courtroom.

~ Father of client, 2001 (Former elected district attorney, current defense attorney)

Rob guided me through the most difficult time in my life ... His preparation for the case and his execution in trial were truly the difference ... I truly trusted him with my life and he came through. Not a great promoter or guy who likes to hype, but he delivers where it counts. I am truly grateful that I selected his name over the vast number of attorneys in the Boston area. I rarely provide recommendations, but in Rob's case, I recommend that anyone facing serious criminal charges, where their freedom and livelihood is at stake, that they contact Rob.

I was one of seven lawyers participating in an 8 week trial for multiple defendants in federal court in Cincinnati, Ohio. Rob Goldstein was one of the other lawyers. His preparation, mastery of the facts and performance in the courtroom were outstanding. I have been in practice for 33 years, with 4 years as an assistant county prosecutor and the rest as a criminal defense attorney. I have had more than 250 jury trials in my career and seen many lawyers try cases. Rob Goldstein is as fine an attorney as I have ever seen.

This has been an extraordinary case. It's not hyperbole to use that word. It raised absolutely state-of-the-art legal issues and serious factual issues as well. I think it's appropriate to recognize and commend Mr. Goldstein . . . for working so energetically and effectively on your behalf. This is in the best tradition of the legal profession and it's really made a difference. You're going to get out of prison many years earlier than you would have absent his skill and dedication.
